Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the SimKit mobile application (the “App”) or website operated by [Insert Your Company Name] (“SimKit”, “us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Service Description
SimKit provides prepaid eSIM (embedded Subscriber Identity Module) data plans for international roaming. We facilitate the purchase of cellular data connectivity provided by third-party global network operators.
2. Device Compatibility and Unlocking
Important: By using SimKit, you acknowledge and agree that:

Device Compatibility: You must have an eSIM-compatible device to use our Service. Not all smartphones are eSIM compatible. It is your sole responsibility to verify your device’s compatibility before making a purchase.

Carrier Lock: Your device must be “unlocked” (not locked to a specific carrier/network). SimKit eSIMs will not function on carrier-locked devices.

No Refunds for Incompatibility: We do not offer refunds if you purchase a plan for a device that is not eSIM-compatible or is carrier-locked.
3. Account Registration
To use certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
4. Purchases and Payment

Pricing: All prices are listed in the App and are subject to change without notice. The price charged will be the price displayed at the time of the transaction.

Taxes: You are responsible for any applicable taxes, duties, or governmental levies associated with the purchase.

Payment: We use third-party payment processors. By making a purchase, you authorise us to charge your selected payment method.
5. Delivery and Activation

Digital Delivery: Upon successful payment, the eSIM profile (provided via QR code or in-app installation) will be delivered instantly within the App or via email.

Activation: The validity period of your data plan typically begins when the eSIM connects to a supported network in the destination country (unless otherwise stated in the specific plan details).
6. Refund and Cancellation Policy
Due to the digital nature of the product, all sales are generally final.

Refund Eligibility: Refunds are only considered if the eSIM is proven to be technically defective due to a fault in our system or the network provider’s system, and our support team is unable to resolve the issue after troubleshooting.

Exclusions: We cannot issue refunds for:

“Change of mind.”

Incompatible or locked devices.

User error (e.g., accidentally deleting the eSIM).

Poor signal coverage in specific remote areas (we rely on third-party carrier coverage maps).

Failure to activate the plan within the specified validity window.

7. Fair Usage and Restrictions

Personal Use Only: The Service is intended for normal personal travel use on smartphone devices.

Prohibited Use: You may not use the Service for any illegal purpose, or in any manner that could damage, disable, overburden, or impair the network. This includes, but is not limited to, sending spam, mass automated queries, or using the data for non-smartphone devices (e.g., industrial routers) that consume abnormal amounts of bandwidth.

Suspension: We reserve the right to suspend or terminate your service immediately, without refund, if we detect usage patterns that violate this Fair Usage Policy or jeopardise the network integrity.
8. Connectivity and Availability
SimKit partners with various third-party network providers to offer connectivity.

Coverage: While we strive to provide excellent coverage, we cannot guarantee uninterrupted service, speed, or specific network availability at all times or in all locations. Service may be affected by terrain, weather, buildings, and network capacity.

Network Management: Actual data speeds may vary. Network operators may prioritise traffic or reduce speeds during times of congestion.
9. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of SimKit and its licensors. The App is protected by copyright, trademark, and other laws of both Australia and foreign countries.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall SimKit, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service;

Any conduct or content of any third party on the Service;

Any content obtained from the Service; and

Unauthorised access, use or alteration of your transmissions or content.
Our total liability to you for any claim arising out of or relating to these Terms or the use of the Service is limited to the amount paid by you to SimKit for the specific data plan giving rise to the claim.
11. Indemnification
You agree to defend, indemnify and hold harmless SimKit and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and disclose information that allows us to provide the Service.
13. Changes to Service and Terms
We reserve the right to withdraw or amend our Service, and any service or material we provide via the App, in our sole discretion without notice. We may also modify these Terms at any time. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
