You buy a travel eSIM. We deliver a QR code and a link to an eSIM that activates when you land. The plan starts when your phone first connects to a network in your destination, runs for the days listed, and then stops. If it doesn’t work and we can’t fix it, we refund you in full. We can’t refund if your phone isn’t eSIM-capable or is carrier-locked – those are checks you do before buying. We don’t sell your data, and we’re based in New South Wales, Australia.

These Terms of Service govern your use of the SimKit website at simkit.app and any apps we publish (together, the “Service”), operated by SimKit. By using the Service, you agree to these Terms. If you disagree with any part, please don’t use the Service.

1. What we provide

SimKit provides prepaid eSIM (embedded SIM) data plans for international travel. We facilitate the purchase of mobile data connectivity supplied by third-party global network operators.

2. Device compatibility

You’re responsible for checking your phone supports eSIM and isn’t locked to a specific carrier before you buy.

  • Compatibility: not all phones support eSIM. The fastest check is to look for an EID in your phone’s settings – we’ve documented this at /compatible-devices/.
  • Carrier locks: phones locked to a specific network can’t use other carriers’ eSIMs. Most carriers will unlock for free on request.
  • Refunds for incompatibility: we don’t refund purchases for phones that turn out to be incompatible or locked. That check is yours to make.

3. Your account

Some features require an account. You agree to give us accurate information and keep your password secure. You’re responsible for activity under your account.

4. Payment and pricing

  • Prices shown at checkout are what you’ll be charged.
  • You’re responsible for any local taxes or duties.
  • We use third-party payment processors. By buying, you authorise us to charge your selected method.

5. Delivery and activation

  • Delivery: on successful payment, we email you a QR code instantly.
  • Activation: your plan’s validity period starts when the eSIM first connects to a supported network in your destination country – not when you install it, and not when you buy it.

6. Refunds

Because the product is digital, most sales are final. We do refund in these cases:

  • The eSIM never activated and our support team couldn’t resolve it.
  • The eSIM is technically defective due to a fault on our side or our network partner’s side.

We can’t refund for:

  • Change of mind.
  • Incompatible or carrier-locked phones (these checks are yours to do before buying).
  • User error (e.g. accidentally deleting the eSIM before use).
  • Poor coverage in remote areas – we rely on third-party network coverage maps.
  • Failure to use the plan within its validity window.

7. Fair use

  • Personal travel only. The Service is designed for normal personal use on a smartphone or tablet.
  • Prohibited use: you may not use the Service for anything illegal, or in any manner that damages or overburdens the network. That includes sending spam, mass automated queries, or using the connection for industrial routers or other non-consumer devices.
  • Suspension: we may suspend or terminate service without refund if we detect usage that violates this Fair Use Policy or threatens network integrity.

8. Coverage and speeds

SimKit relies on third-party mobile network operators in each country.

  • We can’t guarantee uninterrupted service, specific speeds, or network availability at all times in all locations. Coverage is affected by terrain, weather, buildings and network capacity.
  • Actual speeds may vary. Local operators may prioritise traffic or reduce speeds during congestion.

9. Intellectual property

The Service and its original content, features and functionality are the exclusive property of SimKit and its licensors, protected by copyright and trademark laws of Australia and other countries.

10. Limitation of liability

To the maximum extent permitted by law, SimKit, its directors, employees, partners, agents, suppliers and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages – including loss of profits, data, use, goodwill or other intangible losses – resulting from your access to, use of, or inability to use the Service, or from any third-party conduct on the Service.

Our total liability for any claim arising out of these Terms or your use of the Service is limited to the amount you paid for the specific plan giving rise to the claim.

11. Indemnification

You agree to defend, indemnify and hold SimKit harmless from any claims, damages, obligations, losses, liabilities, costs or expenses (including reasonable legal fees) arising from your use of the Service, or from your breach of these Terms.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes what data we collect and how we use it.

13. Changes to the Service and Terms

We may modify or withdraw any part of the Service without notice. We may also update these Terms at any time. Your continued use of the Service after we post revised Terms means you accept those changes.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia.
